Booking Conditions and Terms for Luxury Vacations New Zealand

Please read these booking conditions carefully.  Payment of a deposit to Luxury Vacations New Zealand is acceptance and understanding of these conditions.


PRICES
All pricing in the Luxury Vacations New Zealand website is in New Zealand Dollars (NZ$) unless otherwise indicated.  Pricing is based on operator's tariffs and fuel charges, as at 01 March 2008 and we reserve the right to amend these prices in the unlikely event of circumstances beyond our control that may force increases upon us.


CHRISTMAS AND NEW YEAR SURCHARGES
A surcharge may be imposed by some lodges throughout New Zealand when you are staying over the Christmas/New Year period.  This surcharge is additional to the price detailed, and if applicable we will advise at the time of booking.


FLIGHTS
Unless specifically mentioned, international or domestic airfares are not included in any tour costs.


TAXES
New Zealand Goods and Services (GST) tax, currently at 12.5% is included in all prices.  We reserve the right to increase prices should there be a change to the GST tax rate or if there are further Government introduced taxes.


PAYMENTS

Deposit
A standard non-refundable deposit of NZ$500 per person is required to confirm your booking.  If your booking includes luxury lodge accommodation, the deposit required will be NZ$1000 per person.  Failure to pay the deposit within 10 days of booking may result in the cancellation of your reservation by Luxury Vacations New Zealand.  Please also note that if your booking includes domestic flights, full payment of these flights will be required at the time of booking. 

Final Payment
Full and final payment of your booking must be received by Luxury Vacations New Zealand no later than 45 days prior to departure date.  If full payment is not received by this date, we reserve the right to cancel the booking.  Bookings made within 45 days of travel will require full payment on confirmation of your booking.

Methods of Payment
Payment for your travel arrangements can be made by telegraphic transfer directly into our bank account or by credit card.  Please note that if you are making payment by Visa or Mastercard, a 2% administration fee will apply.  We currently do not accept American Express or Diners Club cards.


AMENDMENTS & LATE BOOKINGS
Any amendments requested by you, once your reservation has been confirmed may incur a minimum charge of NZ$50 per file to cover administration and communication costs.  Bookings made within 14 days of departure date may be subject to a NZ$50 per person late booking fee.


CANCELLATIONS
Having accepted your booking, should it become necessary for you to cancel your reservation 45 days or more prior to departure date, your deposit only shall be forfeited. 

Cancellation made within 45 days of departure will incur the following charges
44-31 days prior to departure - 50% of the total package price
30-16 days prior to departure - 75% of the total package price
15 days or less prior to departure - 100% of the total package price

We strongly recommend travel insurance to cover any cancellation of part or all of your holiday.


REFUNDS
No refunds will be made once travel has commenced; nor will any refund be available in respect of any tours, accommodation, hires, services or inclusions not utilised unless extenuating circumstances apply.  In such instances, final decisions will be made at the discretion of the suppliers whose services are involved.  Weather interruptions to itineraries/tour packages are beyond our control.  We will do all possible to rearrange services in such event, but cannot be held financially responsible for interruption under such circumstances. We strongly recommend travel insurance cover for such eventualities.


AMENDMENTS & CANCELLATIONS MADE BY LUXURY VACATIONS NEW ZEALAND
It is highly unlikely that we will have to make any changes to your tour after you book, but sometimes we may have to make minor alterations.  You will be notified at the time of booking of any known changes in itinerary, hotels or tour price and you are under no obligation to continue with your booking should these prove unsuitable.  We reserve the right to change travel arrangements once a reservation has been confirmed due to safety, adverse weather or any operational reason whatsoever and will notify you or your travel agent as soon as it is reasonably possible. 


ACCOMMODATION
All accommodation in our itineraries where mentioned is based on "Run of House" rooms, unless specifically mentioned otherwise.  Luxury Vacations Zealand has no control over which room may be allocated as Hotel management makes all room assignments.  In addition, if the featured hotel is unavailable, Luxury Vacations New Zealand reserves the right to substitute hotel accommodation of a similar standard.


MEALS
Unless specifically mentioned under the package inclusions, meals other than stated are not included in the tour price. 


PERSONAL EXPENSES
Items of a personal nature, such as (but not limited to) pre-registration or late check out of rooms, laundry, phone calls, tipping, room service, optional excursions, wine & beverages, etc, are not included in tour and holiday costs and are your own responsibility.  Rental vehicle running costs and insurance excess in the event of accident are not included when travelling on a self drive basis.


TRAVEL INSURANCE
Travel insurance is not included in your tour cost. It is strongly recommended that insurance be taken out to protect you against cancellation charges, loss or damage of personal effects, ill health and medical expenses and any other unforeseen insurable events.  Please discuss this with your travel agent at time of booking or book your travel insurance with Luxury Vacations NZ.


AIR TRAVEL & AIRPORT TAXES
Unless stated under package inclusions, no International or Domestic Air Travel is included in the tour price.  Air travel can be arranged through your travel agent or Luxury Vacations NZ can book domestic airfares throughout New Zealand (additional charge).  All prices exclude International and New Zealand departure taxes, customs and immigration fees.


PASSPORT & VISAS
Please check with your airline regarding current passport, visa and vaccination requirements. Generally vaccination certificates are not required for European, US or UK residents travelling directly to New Zealand.  All travellers will require a valid passport to enter New Zealand. Visas for short term stays in NZ (i.e. less than 3 months) are not generally required for US, British and most European passport holders. Please check with your airline at time of booking as to the precise requirements and procedures for obtaining passports or visas. (It is the responsibility of the traveller to hold the above travel documents).


HEALTH & FITNESS

All passengers must warrant that they are reasonably fit and healthy to participate in the tours and holidays. Passengers requiring medical and physical assistance must be accompanied by a companion. Luxury Vacations, their Driver/Guide or agents can not provide this service.


COMPLAINTS
In the unlikely event that a problem occurs during your holiday, it is important that you immediately inform your driver/guide or the provider of the service. If that is not sufficient to resolve the matter, then contact the NZ office of Luxury Vacations New Zealand. If your complaint cannot be resolved satisfactorily at that time, you must write to our office within 30 days of your return to your home country supplying all the relevant details.


SPECIAL REQUESTS
We will endeavour to fulfil any special requests (eg/ dietary requirements) and will pass your request onto our suppliers.  You must advise us of any such requirements at the time of booking.


INDEPENDENT ARRANGEMENTS OR EXCURSIONS
Any land arrangements you make independently which do not form part of the tour are entirely done so at your own risk. Should you book any excursions or additional travel arrangements while on your holiday with us, please note we act only as your booking agent and should anything go wrong with any such arrangements, your rights will lie solely against the organisations supplying such arrangements.


DISCLAIMER
The client accepts that once a booking has been made with Luxury Vacations New Zealand Ltd and the required deposit paid, the client understands and accepts all terms and conditions as outlined. 



COMPANY LIABILITY

Luxury Vacations New Zealand (hereafter referred to as The Company) does not itself operate the transport, accommodation and/or other services detailed in this website.  The Company is not itself a carrier or hotelier, nor do we own aircraft, hotels or coaches.  Therefore The Company is not responsible and does not accept liability for the acts, omissions, defaults or failures on the part of those who actually provide those services. 

The Company will be not responsible or liable (for damages, refund or otherwise) for: war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, technical problems affecting transport or any other circumstances amounting to force majeure or events beyond our control.

The Company acts only as your agent to introduce you to service providers.  We do not accept any legal liability for personal injury, death, delay, loss of any nature, property damage, inconvenience or additional expenses, resulting from acts, omission or negligence whatsoever of Luxury Vacations New Zealand or any other operator including, but not limited to, any liability arising from delayed departure, missed carrier connections, substitutions of accommodations or of common carrier equipment, termination of service, changes in fares and rates, cancellation or double bookings of reservations or tickets or the failure of any operator, nor will we be liable for flight delays or changes to your holiday for health or safety reasons.

The Company reserves the right to substitute service providers of a similar or higher standard at their discretion.  The company also reserves the right to amend or make variations to transport, accommodation and other services.  As such this may necessitate alterations to itineraries and services with appropriate adjustments to costs.

All prices are subject to alteration at the absolute discretion of The Company, and in particular but not limited to when there are tariff or fare variations introduced to us.

Baggage, personal effects and all insurances are the passenger's own risk/responsibility and bookings are only accepted on acceptance of these conditions. 

The company will not be liable for the failure of the client to obtain the correct and required documentation (eg, passports, visas, health certificates), the failure of the client to follow instructions, including but not limited to check in, check out and departure places and times or the delay of, loss of or damage to participants baggage or its contents regardless of whether check with any carrier, provider of accommodation or otherwise.

All agreements and contracts for the supply of products and services are solely between The Company and the Client. All agreements and contracts shall be subject solely to New Zealand law and the exclusive jurisdiction of the New Zealand courts.



OTHER TERMS

Luxury Vacations New Zealand reserves the right to amend the above terms and any condition or policy displayed anywhere on this website at any time without notice. Any amendments to the Terms will be effective immediately when they are posted onto the website.
